Terms of Service
1. Overview
These Terms of Service govern your use of OutBooked’s client acquisition and lead generation services. By engaging our services, you agree to these terms in full. Please read them carefully before proceeding.
OutBooked provides done-for-you outreach and pipeline generation services on a performance-based model. We do not charge upfront fees or retainers — we earn a success fee only when you close a deal sourced through our campaigns.
2. Scope of Services
Our services include campaign setup, lead sourcing, outreach copywriting, and follow-up management. We work to generate qualified conversations and opportunities for your business.
No guarantee of exact volume. We do not commit to a specific number of conversations, leads, replies, or meetings per month. Campaign performance depends on factors including your industry, offer, target market, and seasonal demand. We optimise continuously, but cannot guarantee fixed output numbers.
3. Third-Party Tools and Costs
OutBooked does not cover the cost of any third-party tools, platforms, or software that may be required or recommended as part of your campaign. This includes but is not limited to: outreach platforms, email warm-up tools, CRM software, data enrichment tools, domain or inbox purchases, and any subscription services.
Any such costs are the client’s sole responsibility. OutBooked may recommend specific tools to improve campaign performance, but the client retains full responsibility for evaluating, purchasing, and maintaining those tools.
OutBooked is not liable for any issues, losses, or disruptions arising from third-party tools, including outages, policy changes, deliverability issues, or account suspensions on third-party platforms.
4. Payment and Refund Policy
All payments made to OutBooked are non-refundable in any case. This includes success fees, any agreed setup or one-time charges, and any other amounts invoiced.
By making a payment, you acknowledge that services have been or will be rendered and that no refund will be issued regardless of outcome, performance, or change in business circumstances.
Disputes regarding invoices must be raised in writing within 7 days of the invoice date. After this period, invoices are considered accepted and final.
5. Client Responsibilities
To enable effective campaigns, the client agrees to:
- Provide accurate information about their business, offer, and target audience
- Respond promptly to warm leads and conversations generated by OutBooked
- Maintain access to any tools or platforms required for campaign execution
- Notify OutBooked of any changes to their offer, pricing, or target market
OutBooked is not responsible for lost opportunities resulting from delayed or missed follow-up on the client’s part.
6. Confidentiality
Both parties agree to keep confidential any proprietary information, campaign data, lead lists, and business details shared during the engagement. This obligation survives the termination of services.
7. Limitation of Liability
OutBooked’s liability is limited to the fees paid by the client in the 30 days prior to any claim. We are not liable for indirect, incidental, or consequential damages of any kind, including lost revenue or lost business opportunities.
8. Governing Law
These terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation before any formal proceedings.
9. Changes to These Terms
We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms. Significant changes will be communicated to active clients directly.
